So far as the possession of the property is concerned in India, the law is similar to the British law, so far as seeking a redressal of possession is concerned as well as for seeking rights to keep the possession of a property is concerned. It has been often seen that in case absentee owner there is exploitation by the local person whether he happens to be a lawful tenant, a simple licensee like a friend, relation etc. etc. or sometimes a totally unauthorized person also encroached upon the property of an absentee landlord. In order to retrieve such possession in favour of such absentee landlord/owners, one needs to file a suit for possession and in case the property happens to be rented property and a person needs to have the possession of the same, there is a law which gives benefit to the non-resident Indians to the effect that their case is decided simply on the basis of the written documents like affidavit etc. without going through the hassle of long drawn litigation and the trial of the case. Therefore, the possession can be recovered without any delay.
