That often the custody of children of the strained parents becomes the cause of discord between the parties as both the parties keep claiming the custody of the children. The law primarily is to see that the welfare of the child is to be considered and ultimately the custody is to be given to such a parent with whom the welfare of the child shall be protected. Therefore, the paramount consideration for the custody of the child is the welfare of child. Even if the interim custody or permanent custody is given to one of the spouse, the other spouse has always a right of visitation and the Indian law duly recognises the same and the courts are also considerate that the children are not to be deprived of the love and affection of other parent who is living separately from the children.
